A few days ago, the General Office of the Ministry of Land and Resources issued the "Notice on Doing a Good Job on the Work of Mine Geological Environmental Protection and Land Reclamation Programs", and implemented a system for the compilation and reporting of the "Geological Environment Protection and Recovery of Mines" and "Land Recovery Project." .


The "Notice" proposed that since this year, mining companies will no longer separately formulate mine geological environmental protection and restoration plans and land reclamation plans. The combined plan is prepared with the mining right as a unit, that is, a mining right compiles a plan with the name of the mining right holder + mine name + mine geological environment protection and land reclamation plan.


The "Notice" clarified that before applying for a mining license, an applicant for a mining right should prepare or entrust relevant agencies to formulate plans for mine geological environment protection and land reclamation; when dealing with changes in mining rights, it involves expanding the scale of mining and expanding the scope of the mining area. In case of changing the mode of mining, the plan for mine geological environment protection and land reclamation shall be re-edited or revised; when the concession of mining rights is continued, the geological environmental protection and land reclamation plan for the mine exceeds the applicable period or the remaining service period of the plan is less than the continuation of the mining right. If it is time, it should be reorganized or revised.


The "Notice" requires that the plans prepared by the mining enterprises should be reported to the competent department of land and resources with the corresponding examination and approval authority for examination and approval according to the authority for issuing mining rights. The review expenses shall be included in the departmental budget and no fee shall be charged to the mining enterprise and the establishment unit. Among them, geo-environmental protection should focus on reviewing ground subsidence in the mining area, geological disasters such as ground fissures, aquifer damage, landform landscape damage, etc.; land reclamation should focus on reviewing the conservation of intensive land use and the protection of arable land, and promote the restoration of damaged land priority. For arable land, available for use.


The "Notice" also pointed out that the local department of land and resources at all levels must follow the "double random open" requirement, and urge the mining enterprises to effectively fulfill their geological environmental protection and land reclamation obligations. If the mining enterprise does not reinstate or fails to meet the requirements, it shall pay the land reclamation fee according to law. Those mining enterprises that have not fulfilled their geological environmental governance and land reclamation obligations in accordance with regulations shall be listed in the list of abnormal rights or serious violations of the mining right holders, and they shall be ordered to make corrections; if the rectification is not in place, they shall not be allowed to apply for a new mining license or apply for a mining license. The license shall be extended, changed, or cancelled, and its application for new construction land must not be approved.
